Twining's Tea Latte Launch Promotion 2024 - Ts & Cs

Information on how to enter and the prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.


Eligible Entrants

Entry is open to residents of Australia aged 18 years of age and over at the time of entry. Employees and management (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

How to Enter

To enter, each entrant must, during the Entry Period: visit [www.twinings.com.au/pages/explore-our-tea-lattes] and fully complete the online entry form, including full name, mobile, email address, age,ticking the checkbox to opt into marketing communications from Twinings and submit a response for 'my health, wellbeing and self-care are…,' 'Tell us how you feel about 4 statements' and answer in 25 words or less 'For your chance to win: Please tell us about either 1. how you will enjoy our new Tea Lattes or 2. What flavours you’d love us make for you next?'

Limits on Entry

Limit applies of one entry per person. Entries which in the reasonable opinion of the Promoter: (a) are received outside the Promotional Period; (b) contain defamatory, offensive or inappropriate content or infringe intellectual property rights; (c) are incomplete or indecipherable; or (d) do not otherwise comply with these terms, will be invalid and ineligible for any prize.

Entry Period

The Promotion commences at 12.00 PM AEST/AEDT on 2nd October 2024 and ends at 11.59 PM AEST/AEDT on 30th November 2024 (“Entry Period”).


Selection of Winners

Judging will take place at 11am AEST/AEDT on 2nd Decemeber 2024 at 35-37 S Corporate Avenue, Rowville Victoria 3178. All entries will be judged individually on their merits based on creativity. The best 50 valid entries, as determined by the judges, will each receive a prize. Entries will be judged by a panel of judges from Twinings & Co.

Prize Details

There are 50 sample packs (including a box of each flavour of Twining’s Tea Lattes) to be won, each valued at $28.50.
The total prize pool is $1,425. All prize values are correct as at 16 September 2024 and are in Australian Dollars, but to the extent permitted by law, no responsibility is accepted by the Promoter for any variation in the value of the prize after that time.

Prize Delivery

Prizes will be delivered to the winner(s) within 28 days of the close of the Entry Period. The prize will be delivered in Australia only.
Notification of Winners Winners will be notified in writing by email on or by 14th November 2024.
The names of winners will be published on [insert date] on GWF or third party promoter website.

1 Entries must be received by the Promoter during the Promotional Period. Entries are deemed to have been received at the time of receipt into the promotion database and not at the time of transmission by the entrant. It is each entrant’s responsibility to provide current and accurate information at the time of entry. The Promoter will not be responsible for any incorrect information, including invalid postal address provided by an entrant. The Promoter will only deliver prizes to the postal address provided at entry and will not be responsible for or liable to organise re-delivery of any prize.


2 The Promoter reserves the right, at any time: (a) to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence); and (b) to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. The Promoter’s decision is final and no correspondence will be entered into. The Promoter reserves the right to cancel, terminate, modify or suspend the promotion or amend these terms and conditions, subject to any directions from a regulatory authority.


3 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


4 The Promoter will make reasonable efforts to identify and contact the winners. Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a prize should be directed to the Promoter. If for any reason a winner does not take or redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.


5 The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a prize or in relation to the competition, except for any liability which cannot be excluded by law.


6 If a prize (or a part of a prize) is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize subject to the approval of any relevant body, where required. Prizes are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise by the Promoter. All expenses incurred as a consequence of receiving the prize are the sole responsibility of the winner.


7 The Promoter reserves the right to withdraw a prize if there are no eligible entrants to receive it. The Promoter reserves the right to withdraw a prize if despite the Promoter’s reasonable efforts to do so, the Promoter is not able to identify, contact or locate the winner for a period of 3 months after the draw; or a prize remains unclaimed for a period of 3 months after the draw. The Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize.


8 Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.


9 The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Any cost associated with accessing the promotion, including the Website, is the entrant’s responsibility and is dependent on the Internet service provider used.


10 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to approval by the relevant regulatory authorities, to modify, suspend, terminate or cancel the promotion, as appropriate.


11 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. If in the conduct of this competition, the Promoter is liable for breach of the Non-Excludable Guarantees, the Promoter's liability is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.


12 Any prize supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of any third party supplier or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence), except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify the Non-Excludable Guarantees.


13 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.


14 The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://twinings.com.au/pages/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles (“APPs”) or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the APPs. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the APPs and agree that the Promoter is not liable in this regard.


15 Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their entry (including but not limited to amending, editing, selecting, cropping, retouching, adding to or deleting from any part of the submitted entry) for the purposes of Twining’s business including for promotional purposes without payment. If requested, the entrant agrees to sign any further documentation required to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry. Entrants agree to indemnify the Promoter, its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to or resulting from a breach of the warranty set out in this condition.

Twinings October ‘24 Tea Latte Giveaway (COMPETITION) Ts & Cs

1. By participating, entrants agree to be bound by these terms and conditions. The
Promoter is AB Food & Beverages (Australia) Pty Ltd trading as Twinings (ABN 93
100 637 849) of Level 2, 11 Talavera Rd, Macquarie Park, NSW (Promoter).

2. The competition commences at 12:01am AEST on Wednesday, October 15, 2024, and ends at 23.59 pm AEST on Tuesday, August 25 (Competition Period).

3. Entry is open to Australian residents who are aged 18 years or over (Eligible
Entrants). Directors, management, employees, and their immediate families
of the Promoter, retailers, suppliers, associated entities, and agencies associated with this competition are ineligible to enter.

4. To enter, Eligible Entrants must, during the Competition Period:
(a) like the post on either Facebook or Instagram.

(b) tag a friend.

(c) on Facebook or Instagram, under the competition post reply in 25 words or less a comment to the following prompt: “What’s the perfect thing to do during a tea break?”

5. There will be 10 winners, and each will win the following section of Twinings Teas:

(a) x 1 Twinings Chai Tea Latte to the value of $8.50 AUD
(b) x 1 Twinings Choc Chai Tea Latte to the value of $8.50 AUD

The total prize per winner will amount up to $18.00 AUD (Prize). There will be 10 winners. The Promoter is not liable for any loss, damage or injury suffered as a result of any winner accepting and/or using the Prize, except for any liability which cannot be excluded by law.

6. Judging will take place on Friday, October, 2024 (Judging Date). All entries
will be judged individually on their merits based on creativity and the response that is most deserving/helpful. The best entries as determined by the judge in their absolute discretion will win the Prize. This is a game of skill and chance plays no part in determining the winner.

7. Prizes will be delivered to the address nominated by the Eligible Entrant within 28
days after the close of the Competition Period. Winners will be notified within 48 hours of the judging taking place via direct message on Instagram or Facebook.

8. All Prizes will be distributed after the close of the competition. If a Prize is not
claimed within three months of the Judging Date, the Promoters will distribute
any unclaimed Prizes to the next best ranking entry.

9. Eligible Entrant’s personal information will be collected and used for the purpose of
conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and the Promoters' agents or third-party service providers, for conducting the Competition, or for promotion and marketing (including for direct marketing) (Purpose). By entering this Competition, Eligible Entrant's consent to the use of their personal information for the Purpose. Entrants should take reasonable steps to verify the Promoter prior to providing any sensitive or personal information and should ensure that they only provide this information to verified representatives of the Promoter and not unauthorised third parties.

10. A copy of the Promoters' privacy policy is available at https://twinings.com.au/privacy-policy. The privacy policies contains information about how individuals may access or correct personal information or make a privacy related complaint.

11. Eligible Entrants warrant that their entry is not in breach of any third-party intellectual property rights. Eligible Entrants agree to indemnify the Promoters and their associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of the warranty.

12. Eligible Entrants grant the Promoters a non-exclusive licence to use their name,
likeness, image, voice, and the content of their entry in any way the Promoter wishes in all media for the purposes of the Promoter's business on its website, social media or in any marketing campaign, without payment of royalties or compensation.

13. By using and entering this Competition on Instagram, Eligible Entrants: agree to comply with Instagram's terms of use, release Instagram from all claims based on, related to, or arising from the Competition; and acknowledge and agree that this Competition is in no way sponsored or endorsed by or affiliated with Instagram.

14. The Promoters' decision is final, and binding and no correspondence will be entered
into.

15. The Promoters reserve the right to disqualify individuals who submit entries that are not in compliance with these terms and conditions, to request verification of the social media profile of Eligible Entrants and the age, identity, and residential address of winners.

16. Winners may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted, or modified by the Promoters. These terms and conditions do not exclude, restrict, or limit those statutory rights in any way. However, to the extent that it is permitted to do so by law, the Promoters (including their officers, employees, and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special, or consequential, arising in any way out of the Competition, including, without limitation:

(a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b) any theft, unauthorised access, or third-party interference;
(c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in market value to that stated in these terms and conditions;
(e) any tax implications; or
(f) the Prize or use of the Prize.

17. The Promoters reserve the right in their sole discretion to take any action that may be available to it, and to cancel, terminate, modify, or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.

Twinings Perfect Pairing Promotion '23 & '24 Ts & Cs

Information on how to enter and the prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

Access your own personal Instagram account, follow @twiningsau and send a video or image (via direct message) of your Twinings Perfect Pairing. Ensure that youraccountyour account is made ‘public’ when posting your entry, so it is viewable for judging. Written entries must be the entrant’s original work and must not contain any material which is offensive, defamatory, or objectionable. Entries may be rejected at our sole discretion. Winner(s) will be notified via their Instagram account and through our Instagram page and Instagram story.

If requested, the entrant agrees to sign any further documentation required to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry. Entrants agree to indemnify the Promoter, its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to or resulting from a breach of the warranty set out in this condition.
